Terms of Service

These Terms govern use of the ClockPath time-tracking service. By creating an account or using the service, you agree to these Terms. If you are accepting on behalf of a business, you represent that you are authorized to bind that business.

The service

ClockPath provides time tracking, scheduling, geofenced clock-in, timesheets, reporting, and related workforce tools. Features may change, and some features depend on configuration by the employer.

Accounts & responsibilities

You are responsible for keeping your credentials secure and for activity under your account. Employers are responsible for how they configure the service, for the lawfulness of the data they collect (including location data and any required employee notices and consents), and for their own compliance with wage-and-hour, privacy, and employment laws in their jurisdictions.

Acceptable use

Do not misuse the service, attempt to access data you are not authorized to see, interfere with its operation, or use it to violate the law or the rights of others.

Location data

The service records device location at clock actions when enabled by the employer. Employers must inform their staff and obtain any legally required consent. Time and location records are estimates from consumer devices and may be affected by signal conditions; they should be reviewed by a manager before relying on them for pay or discipline.

Beta

The service may be offered on a beta or pre-release basis. Beta features are provided as-is, may be incomplete or change without notice, and should be validated before being relied upon for payroll or compliance.

Disclaimer of warranties

To the maximum extent permitted by law, the service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that records will be perfectly accurate.

Limitation of liability

To the maximum extent permitted by law, ClockPath and its providers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or wages, arising from use of the service. Our total liability for any claim relating to the service will not exceed the amount you paid for the service in the twelve months before the claim (or, if the service was provided free, a nominal amount). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Indemnification

Employers agree to indemnify and hold ClockPath harmless from claims arising out of their configuration or use of the service, including their handling of employee data and consents.

Termination

You may stop using the service at any time. We may suspend or terminate access for violation of these Terms or to protect the service. On termination, certain records may be retained as described in the Privacy Policy.

Governing law & changes

These Terms are governed by the laws of the jurisdiction designated by ClockPath, without regard to conflict-of-laws rules. We may update these Terms and will revise the date above; continued use after changes means you accept them.
